The decision represents a rare rebuke from the nation’s highest court.

The Litigation Task Force led 157 House Democrats in filing an amicus brief challenging the Office of Management and Budget’s unlawful freezing of congressional appropriated funds in order to further President Trump’s reckless agenda. Their argument makes clear that the President cannot unilaterally bypass the Congress—and thereby the will of the American people—and withhold appropriated funds based on his own priorities or policy preferences.

On Tuesday, House Democrats’ Litigation Task Force led 162 Members of Congress and 29 Senators in filing an amicus brief before the U.S. Court of Appeals for the Federal Circuit challenging President Donald Trump’s sweeping and chaotic tariffs that were unlawfully imposed under the International Emergency Economic Powers Act (IEEPA).

Litigation Task Force Chair Joe Neguse and Ranking Member Jamie Raskin, along with House Democratic Leader Hakeem Jeffries, Ranking Members Robert C. “Bobby” Scott and Rosa L. DeLauro, and Senators Chuck Schumer (D-NY) and Elizabeth Warren (D-MA) led 172 of their colleagues in submitting an amicus brief for NAACP v. US, arguing to the United States District Court District of Maryland that President Trump’s attempts to dismantle the Department of Education (ED) violate separation of powers and lack constitutional authority.
