Today, Co-Chairs of the House Litigation Task Force, Assistant Democratic Leader Joe Neguse and Judiciary Committee Ranking Member Jamie Raskin, issued a joint statement after the United States Supreme Court issued a 6-3 ruling holding that President Trump exceeded his authority in imposing sweeping tariffs under the International Emergency Economic Powers Act (IEEPA). The decision represents a rare rebuke from the nation’s highest court.

The lawmakers’ filing stands up for Congress’s Article I legislative powers and argues that the IEEPA is not a tariff statute and that Congress did not intend or provide for the IEEPA to be used as a tariff statute.

The Litigation Task Force led 157 House Democrats in filing an amicus brief challenging the Office of Management and Budget’s unlawful freezing of congressional appropriated funds in order to further President Trump’s reckless agenda. Their argument makes clear that the President cannot unilaterally bypass the Congress—and thereby the will of the American people—and withhold appropriated funds based on his own priorities or policy preferences.
